Non State actors applaud ICC action in Palestine Situation



American media is lying to the American people. CSOs in Gaza do not see U.S. media in Gaza at any time since 7 October yet we learn alarming distortions are made of real news from recordings we see of alleged newscasts on CNN and other entertainment outlets like CNN, blasting out parochial nonsense in favour of the Democrat Party and its politicians. Sourcing U.S. politicians for news in Gaza may not be the best content because in America politicians tend to be liars and they are seldom well briefed or well balanced.

On 3 March 2021, the Prosecutor announced the opening of the investigation into the Situation in the State of Palestine.

This investigation followed the Pre-Trial Chamber-I’s decision on 5 February 2021 that the Court could exercise its criminal jurisdiction in the Situation in the State of Palestine and, by majority, that the territorial scope of this jurisdiction extends to Gaza and the West Bank, including East Jerusalem.

That means that under certain circumstances, actors committing crimes against the Rome Statute are possibly subject to prosecution in the Court.

Genocide is not referenced in the International Criminal Court allegations against the parties, but the International Court of Justice has adduced that Genocide by Israel is probably being committed.

The Netanyahu Administration has weakened Israel’s Courts so badly they are not relevant in dealing with the Israeli Governments Criminality.

In both Israel and the United States, democracy has deteriorated in what is claimed to be a free society that upholds freedom of the press, but as both the Associated Press and Al Jazeera have faced shutdowns in Israel, and blockage in the USA, each through different methods, Americans see only a very minimal element of the whole truth.

There is a lot that can be said of the International Criminal Court. The foremost observation is that the ICC is grossly overworked yet is achieving at a relatively high level.

The International Criminal Court is precisely that—a court. It conducts numerous trials, procedural and motion hearings, sentencing, and voir dires (the preliminary examination of witnesses or jurors by a judge or counsel), among other proceedings.

The Court has conducted and will continue to conduct trials for numerous individuals accused of crimes, not for countries. The proceedings involving these alleged criminals may be announced in the same press release, as is customary for courts in all jurisdictions.

Hamas which leadership has demonstrated incompetence and a lack of caring for the people it claims to govern, has made no sense in most things it says and do0es at the top level. It’s rebuttal to the foolhardy Netanyahu ‘equivalence’ whining is the same thing in reverse.

Joseph Biden’s cadre of clowns copied Netanyahuby Biden’s command—we suspect staffers realized they were making a huge gaff and were likely told by their legal eagles, they made no sense.

Clowns may make a living being serious yet funny, but like all clowns they should not being taken seriously. The don’t realize they are in the White House and how dangerous a place that is if the clowns inside mislead a nation or even the world.

Joe Biden is widely accpted to be a habitual liar. White House staffers should not be enabling or exploiting that sin.

The reality is that certain alleged criminals have initially been named in the planned indictments and many others will follow. They will all have their day in Court, probably none will appear together or near the same time. Many months and years of judicial process in many courtrooms and many trials are ahead.

Yahya Sinwar, Ismail Laniyeh, and Mohammed Diab Ibrahim Al-Masri are parties who had organized the attacks against Israel on 7 October 2024. Their cases for doing that are weak and those matters of course will be heard separately from other cases. According to The RINJ Foundation which asked that these men be charged, the focus is on crimes that took place related to hostages.


“Those are extremely serious matters and if the witnesses are willing to go through the grueling process of giving evidence and recounting their personal experiences, each of these men who ordered the hostage-taking and the others who did the crimes and who will soon be charged, will be sent to prison for a long time, In my personal view they deserve life sentences,” said Dale Carter, security director for RINJ Women.

“Our organization was able to assist persons who needed health care or counselling related to gender based violence on pr about 7 October 2023, but in the cases of persons harmed while being hostages, we have deferred them to the ICC. That policy decision was taken on 14 October 2023.

“One of the defences of the Hamas men is that the savagery of 7 Oct. was desperation from a wrongful open air prison. But no matter, there is no excuse for using rape as a weapon of war; no excuse for torture; no excuse for violating POW laws, turning captives into ‘hostages’ for barter; and grossly mistreating captives. Apartheid, genocide, torture, mass murder, do not warrant reciprocation with the referenced types of crimes. Descent people report crimes to the keeper of the rule of law or the finder of fact in the jurisdiction and leave the matters to authorities without exacerbating the situation with reciprocating crimes. I am assured that some primary offenders have become deceased following their killing of three women they dragged to Gaza and following or in the midst of their continued wrongdoings, but there are too many others whom Hamas should have imprisoned for past crimes if Hamas was true leadership. I can’t say that in absolute terms because all governments make these failings, but by the same argument, government has responsibility when it encourages crimes rather than punish them,” added Ms. Carter emphatically. “I am glad these men will at least be held to account, no matter what the outcome may be.
