Sir Keir Rodney Starmer has a big problem as does Joseph Biden. Their firing long range missiles at targets in Russia makes cities in their own countries legitimate Russian targets. These weapons are controlled by Britain and the USA.

Only American armed forces personnel in Ukraine and in other U.S. military bases are able to control the U.S. satellites and the proprietary U.S. missile tracking and guidance systems. The same applies to Britain. That is why it is true to say the missiles are controlled by the respective countries.

“I think Joseph Biden has tried to sabotage the Trump Presidency by putting America in jeopardy of nuclear war with Russia. Biden has in a de facto sense been firing American missiles at targets in Russia my sources in Syria tell me. And that is not all. Humanitarian workers here have seen many U.S. troops carrying out war against the people of Palestine and their Lebanese allies and have even become friends. This is a serious stab against the Trump presidency. Without one iota of doubt, the situation in Gaza is a genocide, and I suspect, a genocide supported by Donald Trump who has been paid millions of dollars to support Israel’s annexation of most of Palestine. I wouldn’t be surprised if the rumours here in Gaza are true and the Biden family and the Trump family have been promised ‘beautiful Mediterranean beach properties as their reward,'” said RINJ Foundation Gaza humanitarian project leader, Behar Abbasi.

But Biden has a bigger problem than the world’s scorn. Biden who has thus far dodged arrest warrants from the International Criminal Court (but there could be a case against him) will likely be facing charges of genocide in the USA under the Trump administration, which law (18 U.S. Code § 1091 – Genocide) carries the death penalty, not that this penalty is even likely. Much depends on Trump and his Justice Secretary.

Lawyers consulted say, “internationally there is no excuse for and no defence against genocide once it is proven to have happened, caused by the accused. It’s a serious indictment and a serious felony conviction.”

Biden vetoes for the fourth time what was otherwise an unanimously supported ceasefire resolution for Gaza. Onlookers around the world are devastated and angry.

The United States has threatened the safety of persons and family of persons of the International Criminal Court. Additionally trhe USA has imposed visa bans on International Criminal Court (ICC)  personnel. In return the U.S. Biden government has been advised by the ICC prosecutor Karim Ahmad Khan that he will act within the Rome Statute and prosecute offenders under Article 70.

Article 70 of the Rome Statute criminalizes behaviour that seriously undermines ICC proceedings, including witness interference in the form of intimidation, corruption and threats. These crimes fall under the broad umbrella of acts that threaten the integrity of the Court, also referred to as ‘contempt of court’.

“We condemn threats by U.S. Republican lawmakers of retaliation and sanctions against the International Criminal Court, its prosecutor, Karim Khan, his associates, and their families over the decision to seek arrest warrants for senior Israeli officials accused of war crimes in Gaza,” said  International Service for Human Rights executive director Phil Lynch.

“According to Article 1 of the Genocide Convention, the Contracting Parties, including the United States and Israel, must prevent and punish acts of genocide. Under Article III, those punishable acts include “Complicity in genocide,” such as by knowingly providing the deadly weapons used to carry it out. In 2007, the International Court of Justice (ICJ), in a case involving Bosnia and Serbia, established that the obligation to refrain from providing weapons or other assistance begins the moment a state becomes aware of the existence of a serious risk that genocide may be committed,” writes James Bamford for The Nation.

“For the Biden administration, that moment came in January, when the ICJ found that there was a “plausible” risk of genocide being committed in Gaza against the Palestinian people by Israel.

“Shortly after, in February, the Dutch Appeals Court halted the transfer of F-35 munition parts to Israel on account of the serious risk of International Humanitarian Law violations.

“Further notice came in May with the applications for arrest warrants for Israeli Prime Minister Benjamin Netanyahu and others by the chief prosecutor of the ICC, Kharim Khan. Among the charges against Netanyahu related to Gaza were crimes against humanity, including extermination, murder, starvation of civilians as a method of warfare, intentional attacks against a civilian population, and “other inhumane acts.”

It was the first potential ICC arrest warrant issued for the leader of a Western-style democracy. Nevertheless, European countries including France and Germany issued statements affirming their support for the legitimacy of the ICC.

“The ICC arrest warrants against senior Israeli leaders and a Hamas official break through the perception that certain individuals are beyond the reach of the law. According to Amnesty International, “Benjamin Netanyahu, Yoav Gallant and Mohammed Diab Ibrahim Al-Masri face ICC charges of war crimes and crimes against humanity All ICC member states now under obligation to help bring the wanted men to justice, while non-members states such as USA should also follow suit ‘There can be no “safe haven” for those alleged to have committed war crimes and crimes against humanity’ – Agnès Callamard, Secretary General, AI.

“The wheels of international justice have finally caught up with those who are alleged to be responsible for war crimes and crimes against humanity committed in Palestine and Israel.

“Despite having secured 14 votes in favour, the draft resolution for a ceasefire put forward by the 10 elected members of the Security Council (E10), failed to pass owing to the negative vote by a permanent member, the USA,” said a UN statement.

The resolution text reiterated the Council’s demand for the immediate and unconditional release of all hostages.

The US representative Ambassador Robert Wood who had already sought and was given an amendment, then vetoed the draft resolution after wasting a lot of time with amendments and said in a statement that the U.S. could not support an unconditional ceasefire unless it was tied to releasing the hostages allegedly being held in Gaza by Hamas and other militants—but the draft did unequivocally demand the release of hostages as stated.

Under the UN Charter, the Security Council has the primary responsibility to uphold international peace and security which it has repeatedly failed because of the USA which is now in peril of being removed from its permanent position on the UNSC as the result of the work of the outgoing U.S. President, paving the way for the rough start of the incoming President Trump who was elected in a landslide victory.
